Update 3798: I have a long way to go: BACK IN THE SADDLE

Update 3797: Six sets today for a nice easy morning at Woodbine, glorious weather too. Three of my sets schooled in the gate, and since the gate does not open for schooling until 8:30 am I had a long break between the third and fourth set. Coffee in the track kitchen, followed by a visit to the HBPA office occupied some of that time. Also a lot of reading, which included a great Jay Hovdey column in today's Daily Racing Form! Anyway, all my horses went nicely for an easy morning's work.

There is a lot of discussion on the discussion board these days on the tension between the need to end the practice of horse slaughter (and we all agree it needs to end), and the need to continue to work with those who work in the horse slaughter pipeline (kill buyers) while the horse slaughter practice persists. I try to stay silent and simply learn from these discussions, and I have learned a lot. Today, on one of the threads I posed the following question: New Holland 7/21.

1. Your Message to Congress

When contacting your U.S. Representative, it’s important to remember to be polite and respectful. Here is a suggested script for conveying all of the necessary points to the legislative staffer:

"Hello, my name is [your name] and I live in [your town]. As a constituent, I'm calling to urge my Representative to co-sponsor a new important bill: H.R. 6598, the Conyers-Burton Prevention of Equine Cruelty Act, to prevent horses from being cruelly slaughtered for human consumption.”


2. Please send HSUS your endorsement letter (please go to the wiki for the letter. I don't know how to attach it here!)

If you have an organization or rescue group, please send HSUS a letter addressed to The Honorable Chairman Conyers endorsing H.R. 6598 on your letterhead. The letter should include:

-information about your group (mission, size, location, history)

-why you support stopping horse slaughter (please do include any personal details or stories about rescued horses)

-a specific statement like: "We thank you for being a champion and introducing this legislation. We endorse H.R. 6598, the Prevention of Equine Cruelty Act of 2008, and urge you to do everything in your power to pass this critical legislation immediately."

-Again, the letter should be addressed to, but not sent to: The Honorable Chairman Conyers, but please email it to us at kdupps@hsus.org


3. Background on HR 6598, the Prevention of Equine Cruelty Act of 2008


Conyers-Burton “Prevention of Equine Cruelty Act of 2008”

The Conyers-Burton Prevention of Equine Cruelty Act is Similar to the American Horse Slaughter Prevention Act (H.R. 503/S. 311). The Conyers-Burton horse bill is similar to H.R. 503, prohibiting the knowing and intentional possession, shipping, transporting, purchasing, selling, delivering or receiving of a horse for slaughter. The Conyers-Burton bill is a simpler approach, prohibiting horse slaughter under the U.S. Code that addresses certain aspects of animal cruelty and abuse (known as “Title 18”). It creates a strong enforcement mechanism to prevent killer buyers from crossing the border with truckloads of horses, but only amends Title 18.

Horses are forced to endure long, agonizing trips to Mexico and Canada. Former race horses, work horses, riding ponies, and carriage horses are purchased by “killer buyers” at regular horse auctions, crammed on trucks designed for cattle, and shipped to Mexico and Canada. Undercover footage by The Humane Society of the United States shows live horses being dragged, whipped, and crammed into trucks in 110 degree heat on their way to a horrific form of slaughter. Terrified, they suffer injuries and are trampled as they are trucked long distances for days at a time without food, water, or rest. Heavily pregnant mares, foals, ponies, injured horses, and horses missing an eye must endure these journeys.

The slaughter process is gruesome and painful. Once at the plant, their suffering intensifies. In Mexico, these horses are stabbed multiple times in the neck with a “puntilla knife” to sever their spinal cords. This procedure does not render the horse unconscious, and is not a stunning method. Rather, it paralyzes the horse, leaving him/her twitching on the ground, unable to move or breathe, and then to die from suffocation or from blood loss and dismemberment.

It's time to end to horse slaughter for human consumption. Past votes on horse slaughter bans in the U.S. Congress demonstrate a strong, bipartisan desire to prohibit horse slaughter for human consumption. States have also acted to end horse slaughter within their borders. In May of 2007, the state of Illinois enacted a ban on horse slaughter, shutting down Cavel International, the last operating plant in the country. The two foreign-owned plants in Texas stopped killing horses for human consumption when the United States Court of Appeals for the Fifth Circuit determined that a 1949 Texas state law had outlawed horse slaughter for human consumption.

With the U.S. plants closed, the same numbers of horses are transported long distances to Mexico and Canada, making the need for a federal ban on slaughter/export especially urgent.

This from 12 year old Allison Martino yesterday: Shoot, only one more month until school starts. (time flies when you live with flies)

Yesterday in a Northern California chat room, NSands, RAndrews, PineCone, and SlewTheSlewer came together to save the life of an unbroke thoroughbred colt. Two years old and hardly touched. He goes to live with Nikki in Vacaville, and Ryan Andrews provided transportation. Castration has been set for next week.

And since we are on the subject of Vacaville, there has been 45 horses rescued since Monday from ranch closings. Of those 45, 18 have gone to live with families in Vacaville. I always tell others, Vacaville is the rescue capitol of the world. Residents opening their gates and hearts to animals. In the hills above Vacaville sit dozens of mom and pop ranches. Lots of children, lots of horses. And our friend Tara who rescues race horses, and then gives them away to good homes. From a race track in Vallejo last week Tara bought a tall, handsome gray gelding from horse killer Wade Giles. The gelding needs one year of rest. He has grass and shade. A neighbor has fallen in love. The neighbor is a plumber. A deal has been done. Tara gets a brand new bathtub with fancy faucets, and the neighbor gets the tall gray gelding. Life is good in the hills above Vacaville.

There's another very interesting existing criminal law within Title 18 United States Code - that IMO can/will be used for more effective enforcement of the NEW federal criminal anti-cruelty Horse Protection statute (HR 6598) - it's a tool commonly used by federal prosecutors to get the WHOLE criminal enterprise. Take a look at 18 U.S.C. sec. 2 - Aiding and Abetting.

Many many federal criminal indictments include count after count charged under a substantive federal ctiminal statute together with that good ole section 2. You see, under criminal jurisprudence applying that section, in the HS scenario, EVERYBODY who knowingly assists the perpetrator - especially ahead of time - is JUST AS GUILTY as the active perpetrator. So in the HS scenario, one could imagine a creative prosecutor not only charging the driver transporting equines in violation of the statute, but also EVERYBODY who "helped" - such as auctioneer, broker, etc etc.

This is just an IMO but for those worrying that enforcement will be a nightmare under the new law, remember how those federal prosecutors get whole gobs of defendants and hold them responsible for things actively done only by one . . . or am I dreaming?

No, Ceej. You are not dreaming. I see a tidal flow in this state as it pertains to child abuse. Those that knew and did nothing are receiving sentences as well as the perps. We the people are DEMANDING more. And we keep going.

It's nice to grow older. We become bitchier and demanding, and able to right more wrongs.

The last part of the Cherokee Devotional today:

Making room. Yesterday we said goodbye to Kodak. We said goodbye to Judy. And we said goodbye to Johnny Cash. All three are now with friends. Tall green grass and apple trees. The three horses will return to us when winter comes.

Also yesterday we said goodbye to two horses who were living with us because of fires. Their homes once again safe. Their owners happy to have them back.

So five horses left, and you cannot imagine the difference. Still 107 horses on our ranch, but we now have two empty round pens and room to turn around in our fields.

A big Thank You to Friends Of Tbfriends, and especially the memory of Susie Ingersoll. Two new round pens were delivered to us, and we will set them up soon. Injured race horses who are kept in stalls can now live outside. Thank You to everyone who contributed, and I will do my best to list your names next week.

107 horses are yelling for food, and a new day begins. Later we could be 97 degrees. There is employment at another ranch, earning the big bucks, and also a trip to the feed store. Becky Coombs phones to say Miley Cyrus sings on Good Morning America today. Well golly gee. Another quote from Allison Martino: The smallest moments later become the biggest memories.

Top Left: It has been one month since I bought a preggo mare from a feed lot. The mare was not due to foal for a month, but the very next morning there was a colt on the ground. The mare is a beast. Twice she tried to kill her kid. Jodi Tuft said she has a mare who will gladly adopt the colt. This is a picture from earlier this week. A happy family playing together. The colt from our ranch is running last.

And by the way, every time I try to pet his mom, she wheels and kicks at me. It is doubtful she will be nominated for Miss Congeniality.

It got hot yesterday, and smoke has returned. Lots of horses receiving cold water baths including:

Mornin' Famblee

A question has come up in the CO group, that pertains to the NBFA, and the Farmers' participation in rehoming horses. Anyone know how this is progressing? I've written to the NBFA a couple of times and so far have only received auto-answers that my mail would be reviewed and someone would respond shortly. Was gonna send Chris Heyde a note but I know he's probably overwhelmed at the moment.

Can Shelley, Deb, Daryl or anyone let us know if we should hold off calling our targets for the time being? Hoping you've been able to communicate with Jonna regarding the conversation Jonna had today and can convey anything pertinent to us as soon as possible.

Meanwhile, am thinking of Kaiser, Over Enough, Nala, Maribel and Hans, and everyone else who needs a few extra thoughts. I know many have needs, some don't ask, but will hold them in my heart and prayers anyway.

I saw the report on the news last week end about the lion and his reunion with his adopted parents. It was amazing to watch this lion come out from the brush, and once he realized who he was looking at, his affection was unbelievable. Please see CJ's info above. It's very much worth looking at.

Congress Addressing Horse Slaughter Cruelty in New Federal Legislation

(July 25, 2008) – A bipartisan coalition of lawmakers has introduced legislation to ban the slaughter of American horses for human consumption overseas, as well as the export of American horses to other countries for slaughter. House Judiciary Committee Chairman John Conyers (D-Mich.) and Rep. Dan Burton (R-Ind.) introduced the bill, H.R. 6598, known as the Conyers-Burton Prevention of Equine Cruelty Act of 2008.

In addition to Conyers and Burton, the original co-sponsors of the legislation include Reps. Nick Rahall (D-W.Va.), Walter Jones (R-N.C.), Bobby Scott (D-Va.), Jim Moran (D-Va.), Jan Schakowsky (D-Ill.), Steve Chabot (R-Ohio), Raúl Grijalva (D-Ariz.), Chris Smith (R-N.J.), Debbie Wasserman Schultz (D-Fla.), Jerrold Nadler (D-N.Y.) and Betty Sutton (D-Ohio). The legislation has strong support from The Humane Society of the United States and other animal protection organizations.

“Every day the Congress waits, there will be more torment and more suffering for America’s horses,” said Wayne Pacelle, president and CEO of The Humane Society of the United States. “The horse is an American icon, and it is a betrayal of our responsibility to these animals to treat them like cheap commodities and send them across our borders for slaughter. We ask leaders in Congress for an up or down vote before the end of the session.”

State legislatures have recently acted to ban horse slaughter, shuttering the last remaining foreign-owned horse slaughter plants in the U.S., but Congress has failed to act to stop the export of live horses to Canada and Mexico for slaughter. More than 45,000 horses have been sent across U.S. borders to slaughter in Canada or Mexico so far in 2008, surpassing the number of exports to date in 2007.

Past congressional actions on horse slaughter have demonstrated a strong, bipartisan desire to prohibit killing horses for human consumption. In the 109th Congress, legislation to stop horse slaughter passed the House of Representatives numerous times by a margin of more than 100 votes, and passed the Senate by a more than two-to-one margin. But so far in the 110th Congress, the existing legislation, H.R. 503 by Reps. Jan Schakowsky (D-Ill.), Ed Whitfield (R-Ky.), Nick Rahall (D-W.Va.), and John Spratt (D-S.C.), and S. 311 by Sens. Mary Landrieu (D-La.) and John Ensign (R-Nev.), has not yet been enacted because it has been blocked by House committee leaders and Western senators. Animal advocates hope the new bill will advance quickly in Chairman Conyers’ House Judiciary Committee.

Butchering horses is a particularly cruel end for these loyal and trusting creatures. The HSUS documented the cruelty and abuse when investigators followed “killer buyers” transporting horses thousands of miles from auctions to feedlots to interstate highways. They also documented a barbaric method of slaughter on a kill floor in Juarez, Mexico. Thousands of horses are stabbed with short knives, a method that leaves them paralyzed and unable to breathe. The animals are still conscious as they are hoisted up by a chain and their throats slit.

The HSUS is joined by members of Congress, the National Show Horse Registry, American Horse Defense Fund, Veterinarians for Equine Welfare, United States Equine Sanctuary & Rescue, American Walking Pony Association, American Indian Horse Registry, Palomino Horse Association, United States Eventing Association, National Thoroughbred Racing Association, National Steeplechase Association, Churchill Downs, and more than 500 endorsing organizations along with the majority of Americans in support of the Conyers-Burton Prevention of Equine Cruelty Act.

Timeline:

September 2007 - A three-judge panel from the U.S. Court of Appeals for the Seventh Circuit unanimously upholds the Illinois state law banning the slaughter of horses for human consumption in that state.

May 2007 – Governor Rod Blagojevich signs H.B. 1711, banning horse slaughter in Illinois.

May 2007 – The U.S. Supreme Court announces that it denies to consider an appeal of the lower court decision upholding Texas’ ban on the sale of horsemeat for human consumption.

April 2007 – U.S. House of Representatives passes H.R. 249 to restore a decades-old ban on the commercial sale and slaughter of wild horses first enacted under the Wild and Free-Roaming Horses and Burros Act of 1971. House vote: 277-137

April 2007 – U.S. Senate Commerce Committee voted 15-7 to approve S. 311 to ban horse slaughter and exports of horses for slaughter.

March 2007 - A federal district court orders the U.S. Department of Agriculture to stop inspecting horsemeat at the Cavel International slaughter plant, effectively closing the last operating horse slaughtering operation in the United States.

March 2007 – The United States Court of Appeals for the Fifth Circuit affirms decision upholding a Texas state law banning the sale of horsemeat for human consumption.

September 2006 – U.S. House of Representatives passes H.R. 503, the American Horse Slaughter Prevention Act. The 109th Congress adjourns before the Senate can consider the bill. House vote: 263-146

September 2005 – U.S. Senate approves the Ensign-Byrd Amendment to the FY 2006 Agriculture Appropriations Bill to prohibit the use of tax dollars to pay for inspections of horsemeat. Senate vote: 69-28

June 2005 – U.S. House of Representatives approves the Sweeney-Spratt-Rahall-Whitfield Amendment to the FY 2006 Agriculture Appropriations Bill to prohibit the use of tax dollars to pay for inspections of horsemeat. House vote: 269-158

May 2005 – U.S. House of Representatives approves the Rahall-Whitfield Amendment to the FY 2006 Interior Appropriations Bill to restore federal protections from commercial sale and slaughter to wild horses and burros. House vote: 249-159. The provision is stripped in conference from the final bill.

George Adamson (3 February 1906 - 20 August 1989), the "Baba ya Simba" ("Father of Lions") of Africa,[1] was one of the founding fathers of wildlife conservation and an author. He and his wife Joy Adamson are best known through the book and film Born Free, which is based on the true story of Elsa, an orphaned lioness cub they raised and later released into the wild.

Adamson was born in Dholpur, Rajasthan, India (then British India). He first visited Kenya in 1924. After a series of adventures, which included time as a gold prospector, he joined Kenya's game department in 1938 and was Senior Game Warden of the Northern Frontier District. Six years later he married Joy. It was in 1956 that he came to have Elsa the lioness who would gain world fame and affection.

George Adamson retired as a game warden in 1961 and devoted himself to his many lions. In 1970, he moved to the Kora National Reserve in northern Kenya to continue the rehabilitation of captive or orphaned big cats for eventual reintroduction into the wild. George and Joy separated in 1970, but continued to spend Christmas together until she was murdered in 1980.

On 20 August 1989, the 83-year-old Adamson was shot to death at Kora Reserve by Somalian poachers when he went to the aid of a tourist.[2][3]

Some thoughts about the "new sheriff in town" (as I'm saying to aides who already know me)

It's in the Judiciary Committee - of which Co-author Rep Conyers is Chairman - and I believe I saw someone posted that something like 2/3 of the Committee Members ALREADY are cosponsors of HR 503.

I just called all the IN Reps who cosponsor 503 and some noncosponsors who voted YES for 503 last time. All their staffs were THRILLED to hear of the new proposal and sound like these guys would be coming aboard soon. They all requested written materials describing the new bill and how it's different from 503.

For now, what I've told them is this:

A - no appropriations because it's a regular federal criminal statute administered by the Dept of Justice; and

B - no fears of charging innocent people taking show horses to a show or racehorses to a racetrack or a mare to a studfarm (a stated objection by some to 503) - because as a federal criminal statute, there is a requirement of "mens rea" (a criminal mental state) for prosecution under the new law (6598). There must be proof beyond a reasonable doubt for conviction under the new law, something that did not exist for sanctions under 503.

All the aides I talked to so far followed what I was saying and seemed to "get it."

As I understand it, the appropriations under 503 were for payment of people to inspect and detain horses suspected of being transported in violation of the terms of 503 - all that civil aspect is gone from the new CRIMINAL bill.

###Watched Elephant Diaries last night on Animal Planet and saw the orphaned elephants now released to live on their own. One of them (Emily, I believe) recognized one of her handlers from the orphanage and went over to the truck to "say hello."

She raised her trunk twice to him and while he didn't jump down and "get all mushy" (something I would have done in a heartbeat ;o), he did touch her and after she said her hellos, went on her way with her new pack.

Lordy. Talk about a sweet moment.

Of course, I LOVE "ellafinks" and was just enthralled.

###Another scene showed some new orphans arriving and the "old-timers" (slightly older "babies") rushing up to meet the newbies and then going off to show them their new home and all the neat places to play.

If you get the chance to see that show, by all means, watch it.

I saw Elephant Diaries also. What a great story I was teary eyed when they were trying to get them in the triler. sniff sniff. The ninght before was not so good.

I will not go to a circus due to how those beautiful animals are treated and what they are made to go through. I rode one once, it was wonderful!

Just got back from the ranch a little bit ago and am very tired.Boys were great and I gave Reiki to one of the trail horses who was getting shoes on his front hooves. Hollywood was good as gold...very affectionate and just loved the attention. Spent a little time with Shakkah and a lot of time with Windy and Illusion and a bit of time with Stormy. Windy and Illusion are being so affectionate with me. Roxie (the baby), May (the mare) and Romeo (the gelding) are in the adjacent pasture and they come to visit when I'm with the boys...its like a herd is forming and its the coolest thing...
