    Barbaro Updates: 324

    updates are now here.

Update 2127: Another thursday, another afternoon with Mike Rea at Freedom Hills. Mike rode a different horse today, so it may take a little adjusting, but he looked good jogging around the ring.

Dogwood Stables has announced its Dominion Award winner: Shetron Named Dogwood Dominion Award Winner, excerpt:

Shetron was instrumental in rescuing more than a dozen horses consigned to a livestock auction in Pennsylvania. Shetron and a friend went to Pennsylvania, where they tracked down the Finger Lakes horses. One had already been lost to the slaughterhouse, but over the course of three weeks and several trips to the state, all the other horses were found and purchased. From that, the Finger Lakes Thoroughbred Adoption Program was born. Both the track and the local HBPA help fund the program.

Update 2126: A bit muggy and dreary this morning at Fair Hill. The main track was closed so activity on the Tapeta track was brisk. I only had two to ride today. First out was Nautical Agent, she went to the Tapeta track with Tim on Fortuna. We jogged forward to the 5/8ths pole (as usual) and galloped a mile and a half. I was in front by a couple of lengths and Nautical Agent went nicely. She then high-stepped it all the way home. Next out was Kitty, she went with Nonpariel and we went across the fields. We did a good bit of galloping up the hills and Kitty really grabbed a hold of the bit at the end. She went very nicely.

Joe Bravo, a New Jersey fixture, recorded his 4,000 win ysterday at Monmouth Park: Joe Bravo Reaches 4,000-Win Milestone.

Update 2125: A great day at Finger Lakes yesterday: Funny Cide Responds to Hero's Welcome. Railbird was there for the event reports and took some pictures: Funny Cide adventures & pics! This was Funny Cide's first victory for a year, lets hope its a spring board for a great second half of the year.

Any Given Saturday appears back on track. Earlier in the year he finished a very close second to Street Sense. Yesterday he turned the tables on NoBiz who had beaten him in the Wood: 'Saturday Upstages 'Shobiz in Dwyer.

    Good Thursday morning FOBs,

I hope everyone had an enjoyable 4th. While enjoying the celebrations, let's all remember the horses who need our help. Horse slaughter continues in Mexico and Canada and our U.S. horses are sent there for that purpose. We need federal legislation to stop the process.

Thank you to each one of you for your dedication to all horse related causes. Thank you to Barbaro for bringing us all together and thank you to Tim Woolley and Alex for giving us this site to meet to discuss these issues.

    Have a wonderful Day!!

    Good Morning Frens,

So happy for FUNNT CIDE, and all of the horses who made it home safely , on July 4th.

Oneother who we have taken an interest in, is THE GARBAGE MAN. He came in 2nd, in the 4th race at Evangeline Downs, yesterday. He was claimed for $4000. Let's hope that his new owner and trainer will continue to keep him safe. He is an older horse who has been racing his heart out.

I dread the day that he no longer shows up in my virt stable. Please pray for THE G-MAN.

Have a wonderful day, everyone. Please make your calls, and kepp sending e-mails to your Legislators, to save the horses. The horse you save just might be someone like THE GARBAGE MAN.

    Good Morning FOB's

    Strategy for Thursday July 5

Hope everyone had a wonderful July 4. We had good news from the courts about Caval but that may be short lived. The District Court can decide at anytime to grant the preliminary injunction that would allow them to reopen. The threat is always there until federal law makes slaughtering our horses illegal!

The slaughter of our horses will NEVER stop for good without the passage of federal legislation. Everyday that passes, more American horses are being transported out of this country to meet their horrible fate.

With all three slaughter houses shut down in America, we must now STOP THE CRUEL AND INHUMANE TRANSPORTATION. Tell your Senators/Representatives how much our horses are suffering on their way to Canada and Mexico. Each day the federal legislation is not passed our horses continue to suffer a cruel and inhumane journey.

In lieu of lists this week, you have been asked to contact the representatives in your district:

This week, your representatives will be working in their District Offices. The best thing you can do is to arrange a meeting with members of Congress who have not yet cosponsored, especially those who cosponsored last year. We urge you to try to make an appointment to meet with them in person. You should try to organize small local groups and request a meeting in their district office. Being constituents will make it easier to get an appointment. If the Representative is not available, then the District Director is the next best thing.

In addition, when you contact your Representatives in the House today please remember to urge them to oppose SECTION 123 OF THE AMENDMENT to the 2007 Farm Bill. Section 123 of the Amendment would nullify any State or Federal legislation that would prohibit transport of animals, INCLUDING HORSES, for the purpose of slaughter. It could actually allow the Texas slaughterhouses to open again. You might want to start with HR503 and end with this just to let them know that this bill is trying to make an end run around the federal legislation that we are trying to pass.

For those of you who would like to make calls in addition to our strategy and need direction, you can follow the list posted by Habitat for Horses. But don't forget to call your OWN reps. Also, please continue to follow your state leader's instructions and list.

There is still a need for state groups. they've been VERY effective in getting cosponsors. Right now we're looking for leaders in for Missouri, Louisiana, Vermont and New Hampshire. To find out how you can help, contact sbreaux1@verizon.net

Several offices have informed us that the pro slaughter people are more organized than ever and are making a lot of noise this year. We cant let them be louder than us. Remember.WE ARE BARBARO'S VOICE. Let it be heard!!

Thanks and have a good day!
    Shelley and Debra

MORE AMMUNITION FOR OUR WAR - In doing some research for sending info to Mr. Landman who wrote that wonderful article "Companions not Dinner" that Alex linked to the other day, I found a great link showing the prison programs that use horses, providing a new career in public service for OTTBs - and providing part of the answer to "where will the horses go" when slaughter ends. Surely many more such programs can be instituted, and not only TBs are suitable. Check this out - would someone pls bluelink? Thanks.

Hay Pennsylvanians, are you willing to be a voice for the HORSES?

We really need more co-sponsors to be assured that our bills pass the Senate and House when they are brought to a vote. Pennsylvania is a big Ag state, and we are fighting a tough lobby. WILL YOU HELP US?

We are Team Barbaro Pennsylvania. Our team is now 48 strong and we’d like more of you to join us! We have 9 legislators who have not co-sponsored the bills. We are experiencing success! We do need more assistance, however...

Please tell me you are willing to be a voice for the horses! They cannot speak for themselves!

There are 4 or 5 names to call, fax or email each day Monday through Thursday. It takes but a few moments to speak for the HORSES!

I am the Pennsylvania State Leader. Please email me if you’d like to join our Team Barbaro Pennsylvania and get on the emailing list for targeting our PA Senator and Reps who have not yet agreed to support the anti-slaughter legislation. You can email me at Lor's Email Addy.

    OUR HORSES NEED YOUR HELP!

A few minutes each day for our Horses it not much to ask…is it?

I GET IT. I bet you GET IT too. Let’s ROLL for the silent, suffering horses!

There's still time to honor the Jacksons, Tim Woolley Racing, and the work of the FoB by contributing to the Anna House benefit ad!

Remember: no amount is too small. We're up to nineteen donors, with over $400 pledged and $200 collected. Every $5 or $10 really helps make a reality a full-page ad in the benefit program--and this year's honorees are Roy and Gretchen Jackson, who recently donated $250,000 to begin the Lael Scholarship Fund.

To echo Teresa's previous post (3:36 pm) about the FOB ad for Anna House....at first I didn't plan to contribute because I though "only" $10. wouldn't mean much, but then I realized that if everyone gives just a little we will have a LOT! This is a wonderful opportunity to showcase the work of the Fans of Barbaro, to support a worthy charity...and, for those who contributed to Edgar Prado's birthday tribute, to continue our support of one of Edgar's pet charities!

A day without Joe is like a day without horses...thank god Joe is a dreamer, that he loves sweets, that he sees flies as packing thier tiny suitcases and leaving for Portland, that flies try, but cannot do the backstroke, that he takes in pigs, ducks, cats, dogs, besides the horses. And thank God that he mourns the horse that some idiot trainer sent to the KB because he thought Joe was full up with horses...

I wish I was 25 years younger, and only had one dog (well, not the dog part...) but I wish I could just pack up and go out to help Joe and Cathy. (Then I'd head north a little and meet my dear Lynne laydeeatthefence too.)And I'd get to meet Pony Boy. I just love these guys...

IMHO, they're all about what we are trying to do.
All he has seen and still he has hope. Still he dreams of slaughter coming to an end...how he has kept a tender heart and soul throughout all of what life has shown him....I just do not know. But that you God, for Joe Shelton and Cathy. I am very grateful for them both.

    MORNING REPOST

We can't let them be louder than us. Remember: WE ARE BARBARO'S VOICE. Let it be heard!!

Kathy S. and any other "Bart lovers"!

Kathy, I apologize for not responding to your inquiries of Bart. Work has really put the screws to us being on the internet and I am at lunch now so, Ha-Ha work!

Bart has continued to lose weight, drinking TONS and a very wet litterbox. But still active.

Until today. I went into the backroom because I hadn't seen him during my first 5 minutes being at work. (I need to see his face and give him some love first thing!)

He was laying on the floor, with his head hanging on the edge of his water dish, his chin dripping with water. No energy at all.

I paged the yard foreman, who helps take care of Bart. Mike came into the office and we went back and discussed Bart. Mike was concerned. He shared with me that earlier this morning, Bart was laying in the middle of the drive, in front of the gate and wouldn't move for a truck to get through. A SEMI-truck!

Bart KNOWS to get out of the way. Mike feels that Bart just didn't have the energy. He went over, picked Bart up and carried him inside. And there he layed until I came in.

Bart is at the Vet's office now. Mike and I drove him to my Vet's office. Very close to work. They ran some tests and they found out that Bart IS Diabetic. Blood sugar at 489...healthy is 80-100. Plus, he has a urinary tract infection.

So, my poor baby is (hopefully) on the road to recovery.

My lunch is over but I just want to say a HUGE Thank you to EVERYone who offered advice, prayers, asked about him and offered Kathy pats! Thank you from the bottom of my heart! Your words and concern mean more than I can say.

Kathy, as I left him in the arms of a sweet Vet Tech, I gave him a Kathy pat all the way down to his behind!...he purred!

    Thank you!

    AFTERNOON REPOST

We can?t let them be louder than us. Remember?.WE ARE BARBARO'S VOICE. Let it be heard!!

Thanks and have a good day!

MORE JOBS FOR MORE HORSES -

Great news about development of a nationwide program to provide equine assisted therapy for wounded service personnel and veterans - appropriately called "Horses for Heroes."

NARHA Establishing Program for Wounded Servicemen and Veterans
    by: Press Release
    April 05 2007 Article # 9330

The North American Riding for the Handicapped Association, Inc. (NARHA) has announced it plans to develop a nationwide program for America's wounded service personnel and veterans.

NARHA promotes equine assisted activities at more than 700 member centers in the U.S. and Canada, helping individuals with special needs gain greater independence through their involvement with horses.

"Appreciating the power of the horse to change lives is our goal," said NARHA President Dr. Paul Spiers, "and NARHA wants to provide positive change for these very special lives. Our service personnel have fought to preserve our freedom, and, for many, at a very dear cost. We must be certain that if our wounded service personnel and veterans need and want this kind of help, they will get the best NARHA has to offer."

Over the March 31-April 1 weekend, at a meeting of the organization's board of trustees, committees and membership representatives, NARHA established Horses For Heroes. A task force was formed to develop the program, pilot the methods to be used, educate member instructors, and monitor any services provided through NARHA's nationwide centers.

Based on the success of recent pilot programs at Ft. Hood in Texas, and Ft. Myer in Virginia where the United State Army's 3rd Infantry Regiment Caisson Platoon is headquartered, NARHA wants to use the lessons learned to prepare local centers for these service personnel as they return to their home communities. The Horses For Heroes task force will oversee and facilitate the orderly development of appropriate equine assisted activities, such as therapeutic riding and driving, as well as equine facilitated psychotherapy, tailored specifically to the needs of service personnel and veterans.

"This is a population that only a few of our centers have tried to serve in the past, but it is clear how helpful Equine Assisted Activities can be for our wounded service personnel and veterans," said Chief Executive Officer Sheila Kemper Dietrich, "and we need to provide these opportunities, and approach this in a systematic fashion."

NARHA's national leadership in Horses For Heroes will create a primary point of contact for therapeutic riding centers, potential veteran or service personnel clients, interested health service providers, and for developing the financial resources to support the program. Kemper Dietrich is already negotiating with the Department of Veterans Affairs to create a Memorandum of Understanding between the two organizations.

Looking forward to Calder's Summit of Speed on Saturday. Smokey Stover was the first horse to arrive last Saturday and has had 2 works over the track. It will be bittersweet for his connections as last year's Summit of Speed was Lost in the Fog's last race. He received a great standing ovation from the crowd last year that I will always remember.

The wonderful dog, Brandi, I rescued over a month ago is going to her potential new home tomorrow for the weekend. She has been boarded at my vet for over a month. She was thrown out of a van on Memorial Day. Please keep good thoughts for her, that this home will become her forever home. Brandi and Nala have become very good friends.

We are getting the media exposure we need and we have the momentum to keep the slaughter houses closed and stop our precious horses from going to Canada and Mexico. Please join a state group if you haven't already.

    JUST OUT:

    The judge denied Cavel's motion:

"A federal judge ruled Thursday afternoon that Illinois' ban on horse slaughter is constitutional, after a six-week legal battle between the state and Cavel International, a DeKalb slaughterhouse that was the only facility in the country still processing horse meat for overseas diners.

“Basically, Judge (Frederick) Kapala didn't dismiss the case, but he ruled that the complaint did not establish any violations of the Constitution or federal law, and is therefore denying the motion for injunction,” Assistant DeKalb County State's Attorney John Farrell said. “This is what we were hoping he would enter last week instead of the judgment he did enter, which suspended the case pending the outcome of the Humane Society's appeal.”

On June 25 Kapala issued a statement saying he lacked jurisdiction to rule on the case until a federal appeals court determined whether The Humane Society of the United States could intervene in the case as a defendant. The appeals court said Tuesday that Kapala did have jurisdiction, and ordered him to make a final judgment before moving ahead on the appeal.

Farrell said he expects Cavel to appeal the ruling."

WE the people, ask that they listen to us with open hearts and with open ears. Horses are America's Icon, just like America belongs to all of us.

How can they do a roundup?

First of all, HR 249 is NOT IN EFFECT yet; it passed the House, but was not yet voted on in the Senate. (Sound familiar???)

And even if it were in effect, I think the provisions of HR 249 only prohibit COMMERCIAL USE of the wild mustangs and burros, either for meat or for hides. They can still round 'em up and warehouse and/or rehome; don't know what they plan to do with them. I will go to that thread and ask the poster to try to post add'l info.

Whatever the details, PLEASE go to that thread I posted here and send comments to the BLM based on the info in that thread. THANKS!

Just spoke with Allison in Sen. McConnell (KY) office about S. 311. She stated Sen. McConnell has no plans to co sponsor this legislation.

She said they have heard from many people in Kentucky that are for this legislation.

I asked her if there was any information that she was getting from the pro slaughter side that I could counter. She said no, she felt Sen. McConnell was well informed about both sides of the issue.

I did inform her of today's ruling on Cavel. She indicated she knew of this ruling. I reminded her that horses can still be transported to Mexico or Canada and that S. 311 still needs to be passed.

Pretty non committal. But, I would continue to inform the office of new developments.

I'm back from my meeting with my own Representative here in Arizona. I won't post any specific details here, but all I can say is that I am VERY glad I went.

What I learned is that now that the two big bills dealing with the Iraq War and Immigration are behind them, these legislators now have a little time to spend on other bills.

I covered everything we have ever talked about here, so there is nothing you haven't heard us all mention.

My Representative LISTENED to everything I had to say. He did not know all about it, as many of us who have studied it. I honestly think my meeting had a HUGE IMPACT.

I can't say enough that you need to get out there and do the same thing. I realize we can't ALL do this, but please make every effort if you think you can.

Now, I can take everything I learned in this meeting back to our state group and use it as strategy for the coming weeks.

THIS IS WHY YOU NEED TO BELONG TO A STATE GROUP. We can share inside strategy about each legislator to address their concerns about the legislation.

    PLEASE, do two things:

    1. Get involved with a state group.

    sbreaux1@verizon.net

    2. Make an appointment to meet with your own district Representative or Senator.

    Now, GET OUT THERE !

I just took a quick look at the judge's decision, and it does appear to me that he has ruled on the merits of the case. The hearing on June 14, 2007 was a consolidated hearing on the application for preliminary hearing AND trial of the action on the merits. Testimony was offered on both. After the Plaintiff (Cavel) entered its evidence, the State of Illinois made a motion for a directed verdict. What that means is that the State was asking the judge to dismiss Cavel's claims based on the fact that Cavel had not presented any evidence to sufficiently support it's claim. The judge reserved his ruling on the motion for a directed verdict.

In the judge's order today, he discusses each claim made by Cavel in detail. At the end, he says that he is granting the motion for judgment against Cavel. In a footnote, the order says "Although counsel referred to this motion as one for a "directed verdict", because this was a hearing before the court sitting without a jury, the court construes defendants' motion as a Rule 52(c) motion for judgment against plaintiffs which the court has the discretion to reserve ruling on until after the close of the evidence."

Therefore, it appears to me that the judge has made his ruling on the merits of the case. I think we are now headed for the Court of Appeals on the merits -- so I think this is good news in that we don't have to wait for a trial on the merits. Of course, Cavel will file an appeal with the Seventh Circuit Court of Appeals. Once that Court rules, I'm sure it will be appealed to the U.S. Supreme Court.

    ### Afternoon FOBs! A positive article on USFS pack animals. Those pack mules are awesome! The ones I've met are crossed with Belgians, so they're some big 'ol mules! :0)

Sort-of Pensions for U.S. Forestry Pack Animals
    by: The Associated Press
    July 01 2007

U.S. Forest Service pack animals that have outlived their usefulness in the backcountry are finding the good life in the pastures and back 40s of some north-central Montana ranches and hobby farms.

Horses and mules that once hauled supplies and tools and rangers for the Rocky Mountain Ranger District of the Lewis and Clark National Forest now help kids learn to ride or simply hang out as pets after decades of Forest Service work.

In May, three horses and eight mules were adopted out after years of service.

Joan Farmer, of Great Falls, adopted a 28-year-old mule named Rose.

"She is adorable," Farmer said. "My family has a farm out of Geraldine and I had two old horses. One of them had to be put down and we were looking for a companion for the remaining horse and a young saddle horse that I ride.

"It is a wonderful program. These animals are so well-trained. They have been at the fair and in parades. My mule was in good shape. She is graying a little."

It wasn't always happy trails for such critters. When a packhorse or mule was no longer worth keeping, a long-faced Forest Service worker would trailer the stock to the nearest sale barn. It was a sad trip for both packer and pack animal that often ended at the cannery.

"Some have put in literally 25 years of work for the American people, so we get pretty attached to them," said Kraig Lang, a wilderness ranger on the Rocky Mountain District. "We feel they have put in a lifetime of service. Literally I would be in tears walking these animals out of the trailer into the sale. It was one of the worst duties you could be assigned to--the guy who had to drive the trailer full of animals down to the sale.

"When we took animals to Western Livestock Auction, we used to get a pretty decent price. We would recoup about a third of the value of replacing that animal. Those prices have dropped to the point that the last time we took a white mule we got $13 for it. That was two years ago. It cost us more to get the animal there than we got out of it. On top of that we know and acknowledge some of those animals were ending up at the slaughterhouse."

But Lang and Ian Bardwell, stock manager for the Forest Service in Choteau, found a government loophole big enough to drive a pack string through.

Since the pack animals are government property and cannot be given to private individuals, Bardwell and Lang donated the stock to Bright Eyes animal shelter in Choteau, which set up adoption of the animals by private individuals.

"I stole the idea from a gal down on the Bitterroot," Bardwell said. "I worked with the regional office in Great Falls and found a code that allows us to donate our critters through a nonprofit agency.

"You hate to spend several years or a whole career with an animal and then send them down the road to get their heads knocked off. This was an opportunity to give them a retirement home. They have several years of good living in ,but they won't be pounding down the trail 50 to 60 miles a week. Now they might get a couple trips a summer or light riding in back pasture or be a baby sitter for folks who have younger animals."

A newspaper ad drew 200 responses. From those, about 50 people made serious applications to adopt the animals.

Forest Service staffers winnowed the applicants down.

"We had folks write us a letter telling us their intent for use of the critter, what facilities they have and other animals," Bardwell said. "They are kind of a herd animal and we gave preference to those folks who were trying to expose kids or grandkids to horses or mules. We have the interest of trying to get young folks interested in stock, natural resources, and outdoors and National Forest lands."

Trish King, of Fairfield, adopted Snip, a bay gelding believed to be a 24-year-old Walker cross.

"My kids are so happy. Snip is such a wonderful animal," she said.

King has keeps other stock on her 5½ acres near Fairfield, and her mother keeps stock, too, on another 22 acres.

"He fits in very well," she said of the adoptee. "He is a therapeutic horse for my kids, who are 5 and 4. For little kids, putting them on a rank horse is not a good idea. Snip is very mellow and very gentle."

King has had Snip since the day before Easter.

"This horse is just for pleasure," King said. "We had to write a letter stating what we would use him for, what living conditions would be like, just basic care of him.

"I think he has given me and my kids more than I have given him."

Jack O'Conner, a retired rancher at Raynesford, took a pair of mules that the Forest Service did not want to separate.

"They get used by the grandkids. One of the mules is kind of a leader and the other is a follower. You put one of the older kids on the driver and two or three that don't ride so well on the follower and you turn them lose and let them go," O'Conner said.

The mules, Kate and Dolly, are 21 and 28 years old.

"When we got them home, I kept them in close until they got used to the area. We let them out into a pasture that hasn't been used for two or three years so there is a lot of grass.

"I said, 'Let's halter these girls and lead them around the fence line.' We did and if speed is any indication they are in pretty good shape."

O'Conner says he has two other horses.

"They are pretty much retired, too. Kind of like everything else around this ranch. I'm retired, the mules are retired, and the horses are retired."

Lang says there are 50 to 55 government-owned animals on the Rocky Mountain Ranger District and in the summer another 20 to 25 personal animals used by their owners.

Bardwell says the ranger district probably won't have other animals for adoption for several years.

"It is something I had been putting off," Bardwell said. "We had critters we were kind of nursing along, like one old mule that did three parades last year. He walked down Main Street three times. but we have a hard time justifying keeping a whole pasture full of critters around that we cannot use."

    ### Another positive article to use as evidence that people ARE working towards alternatives to selling horses to slaughter. Something else to add to the arsenal!

Program to Help Feed Horses Launched by Kentucky Group
    by: Press Release
    June 29 2007

The Kentucky Horse Council has announced a new program to assist horse owners who cannot provide adequate feed due to temporary financial setbacks.

The Equine Safety Net program is designed to provide a 30-day supply of feed for horses when the owner is having temporary financial difficulties and is unable to supply adequate nutrition. This program is for individuals only, and is not intended for professional equine businesses. Applicants can apply for feed for a maximum of two horses, and can receive assistance once during a two-year period. Applicants must also provide evidence that they have provided responsible care for their horses in the recent past.

To be considered for the assistance, the individual can be referred by a Kentucky Horse Council member. If they do not know a Horse Council member, they can call the Kentucky Horse Council office directly, where additional information will be requested for proof of eligibility.

"This program highlights the Kentucky Horse Council's genuine concern for the health and welfare of horses in our state," said Madelyn Millard, president of the Kentucky Horse Council. "Often a horse owner is truly caring of their horses, but may run into an unpredictable financial circumstance which forces them to make some very tough choices. This program provides for their animals while giving the owner some time to decide what alternatives they have regarding the long-term care of the horses."

In order to apply for the Equine Safety Net program, contact a Kentucky Horse Council member to refer you, or call the office directly at 859/367-0509 and request Safety Net assistance.

The Kentucky Horse Council is a nonprofit organization dedicated, through education, to the protection, growth and development of the equine industry in Kentucky. For more information about the Kentucky Horse Council, visit www.kentuckyhorse.org.

SAPL Press Release re Cavel Ruling
    http://www.saplonline.org/news/cavel_injunction_denied.htm

    FOR IMMEDIATE RELEASE:

Illinois Law Banning Horse Slaughter Upheld in Federal Court

Rockford, Ill. (July 5, 2007) US District Court Judge Frederick Kapala rendered a decision today against Cavel International, the last remaining horse slaughter plant in the US. Judge Kapala was not persuaded by the plant's attempt to declare a recently enacted Illinois law making it a crime to slaughter horses for human consumption unconstitutional.

On May 25, 2007, Cavel had filed suit in federal court challenging the enforceability of Illinois' law banning horse slaughter. In early June, Judge Kapala granted Cavel a temporary restraining order, preventing the state from prosecuting the slaughterhouse under the law. He subsequently extended that protection for 10 business days but then denied any further injunctive relief to Cavel on June 25, 2007. Judge Kapala did not believe he had jurisdiction to make any further determinations on the merits of this case due to an appeal pending in the US Court of Appeals for the 7th Circuit. However, on July 3rd, the 7th Circuit ordered Judge Kapala to proceed on Cavel's request for further injunctive relief and with a final decision on the merits of the case.

Judge Kapala analyzed Cavel's arguments that the Illinois state law is preempted by the Federal Meat Inspection Act, a violation of the Commerce Clause, and a violation of the state's police power. In rendering his decision against Cavel he found that the slaughterhouse "failed to demonstrate any constitutional infirmity" in the state law.

"We are very pleased to have a federal court ruling that upholds the constitutionality of Illinois' state law banning horse slaughter," said Tracy Silverman, an attorney with the Animal Welfare Institute (AWI). "This decision is one more important victory on the road to banning horse slaughter in America once and for all."

Attorneys for Cavel International may appeal the decision to the Court of Appeals. However, today's ruling means that the doors remain shut on the slaughter plant, sparing the lives of thousands of America's horses.

AWI is being represented in this matter by the nationally renowned law firm of Patton Boggs.

The Animal Welfare Institute, founded in 1951, is a non-profit organization dedicated to reducing the sum total of pain and fear inflicted on animals by humans. AWI's legislative division, the Society for Animal Protective Legislation (SAPL), is leading the national campaign to end horse slaughter and advocating passage of the American Horse Slaughter Prevention Act. Hello FOB's and Sweet Barbaro,
So nice to read about Funny Cide's success. The year he won the Derby we drove up to Saratoga to catch him in the Travers. Alas, he was scratched from the race as well as another horse who was a top Derby contender that year (I wish I could remember his name). We enjoyed the day anyway despite finding no place to sit most of the day. It is such a pretty location and I hadn't been there since I was a child. We will have to give it another go on a less popular day.

Such great news about Cavel! We still have a few months left to put an end to the horror before the end of the year.

Have mostly had time only to "lurk" of late, but am still here, still loving Barbaro, all the horses and the FOB's. Best wishes to all.

I can tell you that I toned down and edited some of the images.

But the main thrust of the video is to sound out as an ANTHEM for those who fight to end horse slaughter. It shows many of those, politicians included, who are fighting for this cause.

We should ALL know what we are fighting for...it is the least we can do for these animals...they are the ones who suffer these indignities...

I hope you understand...I love you all, and would not subject you to a litany of horros...That is not what the video is about...

Hiya, FsOB! What awesome news about Judge Kapala's ruling in the U.S. District Court in Rockford, IL. Question for any FsOB who happen to be attorneys? Is it a violation of some sort of legal 'etiquette' to send a note of thanks to Judge Kapala? (I had sent one to the Governor of IL when he signed the anti-slaughter bill into law.) If someone could respond here, I'd be grateful. Otherwise, over the next week I'll try to reach a friend who is an atty.
But we need the Federal legislation now more than ever. And as a KY borne female and a Univ. of Lousiville alum, I am soooo disappointed (although not surprised) that Senator Mitch McConnell is refusing to co-sponsor S-311.
I am grateful to the person who posted the info re. the KY Horse Council's proposed Equine Safety Net. Great creative thinking and problem-solving! Wishing each of you a great Friday and a super weekend. Peace, RMH

    #### To Laurie H.: Will you be giving insulin to Bart at work? What will happen on weekends? He is incredibly fortunate to have a caring human friend such as you, Laurie! ####

    ####

To all of Bart's concerned famblee,

I went to the Vet's after work to talk with the Dr. They asked if I wanted to visit with Bart while the Dr. was still in an appt. Of course, I jumped at the chance!

Bart was laying on the blanket that Mike and I took in for him. (This is a blanket that I had taken to work for myself. It got cold by the front door. It's a kid yarn blanket. The first shearing of a lamb...SUPER soft. Bart fell in love at first sight and touch of the blanket... it has been his since he first laid eyes on it. I, in the meantime, froze!)

He's not real peppy. My heart broke when I first saw him this afternoon. But, they asked me to offer him some baby food on a tongue depressor. I did...and he ate! I was there for about an hour, in between times, the Dr. would stop in and chat with me about Bart's care and maintenance.

It turns out, that one of the insulins that I am on (I'm on two) Bart will need the same insulin. So...I won't need to purchase insulin JUST for Bart. We are going to share! I don't use all of the insulin in the bottle before it should be tossed so there will be plenty to share...with my baby, my friend, my buddy.

The plan is tomorrow morning, the Dr. will call me. She's thinking that tomorrow afternoon, I may pick Bart up and bring him home, to the office.

I want to thank everyone for your care and concern for Bart. I hope this is his road to recovery. I have had a conversation with the Dr. that in case the injections and testing, etc. are not within a "happy world" for Bart, that a decision made need to be made. She stated that that was understandable and that she would be there if Bart needed her.

I also want to add, the Dr. tending to Bart is not my kids' Vet. She's in the same office and employed by my Vet but I did not know her before today. She said that being I decided to keep Bart there tonight, that she would make a special trip in to check on him...

I feel that Bart is in the best place possible for his care. He is being tended by a Vet who cares, he is in the hearts of many Fans and tonight I pray that Barbaro watches over him while he sleeps.

May he dream sweet dreams of blueberry doughnuts, roast beef with mayo and enjoy watching his Angel Barbaro win yet another race while being entertained tonight.

Thank you everyone for loving Bart. He is such a joy...

You are the best - having diabetes yourself, you know what you are in for. Adjusting medication, urine testing, timing meals, etc.

Bart is lucky to have you in his life!

Laurie H - Thank you so much for so many things ... mostly - for being YOU ..... and for caring the way you do about Bart - Timing is everything ....... and though you found him in such a compromised place earlier - he was waiting for you ..... to help him from his discomfort and illness - to the more comfortable place - giving you the opportunity to share, not just your love - but your meds - and .... your soft, snuggly - "blankie !" It all fits !!! He knows .....
Barbaro knows ....... and, we know ......
    how wonderful you are !

I have watched Pamela's video several times and each time it stirs something inside of me. Yes, there are a couple of images that you might consider disturbing....but, folks, this is the reality of the situation....it IS disturbing.

However, that's not what the video is about. It is a beautiful tribute to those that are fighting to help end this horror. It is impossible to make a tribute like this without addressing what it is that we're fighting for. Turn up the volume to get the full impact of this video.

I believe that everyone represented will be proud to be a part of this moving tribute.

####LaurieH--You are Bart's Angel. Thank you for that report on him. We are keeping him close in our thoughts tonight and praying that tomorrow when you see him his eyes will be bright and he will feel much better.

    Sorry,

The video was too much for me. I know how horrid this is without seeing any of those images. JUST MY OPINION, but I had to turn it off.

    Pamela,

I love most of your videos, but I just couldn't handle this one. We all have our own different thresholds. Mine is quite low.

Thanks for doing the video. There are those out there who have higher thresholds who NEED to see it.

    (Edited press release)

Jockey Frankie Dettori was suspended July 5 for 14 days for overuse of his whip while guiding Ramonti to victory in the the June 19 Queen Anne Stakes (Eng-I) at Royal Ascot.

A disciplinary panel was told that Dettori struck his mount 25 times inside the final 500 meters of the race.

The suspension is from July 13-26, allowing the jockey to ride English Derby (Eng-I) winner Authorized in the King George VI and Queen Elizabeth Diamond Stakes (Eng-I) July 28.

Dettori appeared before a Horseracing Regulatory Authority hearing, admitting he broke the rules by hitting Ramonti with excessive frequency without giving him time to respond.

Ramonti was the surprise winner of the June 19 Queen Anne, beating favorite George Washington, who finished fourth.

    Hi everyone,

I just wanted to make people aware that there's an eBay seller out there named gregmikie who is selling Barbaro items using my stolen photos. Please don't bid!

I've contacted them, but haven't heard back yet.

    Thanks!!!

For anyone interested, I've begun putting some Barbaro shots back on my web gallery - www.barbaralivingston.com/gallery/ - and shall add a few more Barbaro things in coming days. My apologies for putting credit lines all over them!

    Keep fighting the good fight.

Barbara Livingston - Your photos of horses make my heart sing. Thank you for bringing their reality close enough to wrap our hearts around.

I am sorry, as we all are, that the business end of this art is not as pure as the subjects of your camera. Good luck with tracking those lacking integrity.

I hope Joe at TB Friends is not right... he made a real point on this day after Independence Day:

    -----------

I saw my friend Paul Sedgewick, and he brought me a Daily Racing Form. There is an article by a man named Jay Hovdey, and he writes about how old race horses are being sent to slaughter in Mexico and Canada. This bothers me beyond words. All the race tracks in California know we will pay the same prices as a killer.

A recent conversation with a trainer at Bay Meadows, and he tells me how he sold a classy old horse to slaughter because he thought my ranch was filled. Huh? I explain there is always room for one more. We have almost 100 horses in foster care, and new foster parents are being approved all the time. The trainer says okay sorry, but the horse had bad wheels.

Bad wheels? Horses have legs, not wheels. Horses are living breathing souls, not an old junk of a car sitting in a back yard somewhere. To be butchered alive is the ultimate disgrace. I cannot imagine the horror...

Katie Cooper phones from San Francisco, and she says you should see this crowd. Katie is next to the Golden Gate Bridge, waiting for darkness and the fireworks show. Katie just turned 15, and she tells me how much she loves America. This is the best holiday. Strangers coming together to celebrate a birthday. Before hanging up Katie once again says you should see this crowd. And how lucky are we to have all of these freedoms?

5:45 on a Thursday morning, and I am rambling. Already I have been to the barn, and Pony Boy was waiting at the gate for his first peppermint. 103 horses begin to move around. On the barn radio is Roberta Flack singing about seeing your face for the first time. A gelding from the race track, his name is Capricious One, but we call him Cap. Sometimes we call him Captain. The sweetest gelding on earth, and he may be leaving us soon. There is a girl in Sacramento who has been here to see him twice. She calls everyday, wanting to know if Cap is still here. There are 4 piles of poop in his stall. A busy night. Porky Pig gives a snort and waits for her banana. Barn cats circle my legs. How lucky are we to have all of these freedoms?

Late night ESPN, and they show an older lady at a ball park. She is eating a pretzel, and there is mustard on her mouth. The lady wears a shirt saying God Bless America. She waves to the camera. And I know she is feeling exactly what Katie Cooper is feeling.

I have always loved American Idol, probably because of the possibilities. Anyone can reach their dreams. And it is our dreams which we hang on to. Our dreams provide the courage to keep going.

It cannot be about a cold, indifferent horse trainer. Or a killer who sits in his trailer watching Wheel Of Fortune while ignoring hungry horses waiting to be butchered. There has to be more than that. There has to be Katie Cooper telling me over and over you should see this crowd. There has to be an old lady at the ball park with mustard on her mouth. Early on a hot Thursday morning, there has to be Capricious One greeting me like he is working the front door at Wal Mart.

I wish we could stop horse killers from crossing both borders. But this will never happen. Still, when there is a dream...

    Joe

    -----------

Joe breaks my heart when he opens his.
